Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using CaretakerHelp.ai ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.

2. Service Description

CaretakerHelp.ai is a HIPAA-compliant platform that provides family caregivers with:

• AI-assisted benefits eligibility screening and guidance
• Medication tracking and interaction checking
• Secure document storage for medical and legal records
• Care team coordination tools
• Caregiver burnout prevention resources

All AI features are designed to assist and inform, not to replace professional judgment. Eligibility screening results are estimates based on the information you provide and publicly available program criteria. Actual eligibility is determined solely by the administering government agency or organization.

3. Account Responsibilities

You are responsible for:

• Providing accurate and truthful information during registration and use
• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access to your account
• Using a strong password (minimum 12 characters with mixed character types)
• Enabling multi-factor authentication when available

You must be at least 18 years old to create an account. Accounts are for individual use only and may not be shared.

4. Care Recipient Consent

If you enter information about a care recipient (such as health conditions, medications, or financial details), you represent and warrant that:

• You have legal authority to act on behalf of the care recipient (e.g., power of attorney, legal guardianship, or explicit consent)
• The care recipient (or their legal representative) has been informed about and consents to the use of this platform to manage their information
• You will use the care recipient's information solely for the purpose of coordinating their care and navigating benefits on their behalf

You are solely responsible for ensuring you have proper authorization before entering any care recipient data. We may request documentation of authorization at any time.

5. Subscription and Billing

CaretakerHelp.ai offers both free and paid subscription tiers. For paid subscriptions:

• Billing occurs on a recurring monthly or annual basis as selected
• You may cancel at any time; access continues until the end of the billing period
• Refunds are provided on a case-by-case basis within 30 days of initial purchase
• We reserve the right to change pricing with 30 days' advance notice
• Free tier features may be modified at any time

6. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful purpose
• Upload malicious files or attempt to compromise system security
• Share, sell, or distribute another person's protected health information
• Attempt to reverse-engineer, decompile, or extract our AI models
• Use automated scripts or bots to access the Service
• Impersonate another person or misrepresent your authorization

Violation of these terms may result in immediate account suspension or termination.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARETAKERHELP.AI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

We do not guarantee the accuracy, completeness, or reliability of any benefits eligibility information, AI-generated guidance, or drug interaction data. You acknowledge that decisions made based on information from our Service are made at your own risk.

8. Intellectual Property

The Service, including its design, code, AI models, and content, is owned by CaretakerHelp.ai and protected by intellectual property laws. You retain ownership of any data you upload. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service, in accordance with our Privacy Policy.

9. Termination

You may close your account at any time through your account settings. Upon termination, we will delete your personal data and protected health information in accordance with our data retention policy and applicable law. We may retain de-identified, aggregated data for analytics purposes. We reserve the right to suspend or terminate accounts that violate these Terms.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
